SKILLPOTS – Terms & Conditions

These Terms & Conditions (“Terms”) apply to your use of the SKILLPOTS job advertising and recruitment platform (“SKILLPOTS”, “we”, “our”, “the Platform”). SKILLPOTS is owned and operated by SKILLPOTS, incorporated in Australia under ABN 55 835 332 293

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy, which is based on the Australian Privacy Act 1988 and the Australian Privacy Principles.

Introduction

The Platform allows job seekers to create profiles and apply for roles and allows employers to post vacancies and manage applications. These Terms form a binding agreement between you and SKILLPOTS.

If you do not agree, do not use the Platform.

Eligibility

To use the Platform, you must:

  • Be at least 18 years old.
  • Have the legal right to work or recruit in your relevant jurisdiction.
  • Use the Platform only for lawful purposes.

Employers must comply with the local country specific employment laws, and any applicable anti-discrimination legislation.

Accounts & Registration

  • You must provide accurate, complete and current information.
  • You are responsible for your login credentials and all activity under your account.
  • We may suspend or terminate accounts that violate these Terms or involve fraudulent activity.

User Content & Licence

“User Content” includes CVs, job postings, messages, documents, and profile information.

You grant SKILLPOTS a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce and display User Content solely for providing our services.

You confirm you have the rights to upload such content and that it does not:

  • Infringe copyright or intellectual property.
  • Contain illegal, discriminatory, misleading or harmful material.
  • Violate privacy or confidentiality obligations.

We may remove any content at our discretion.

Employer Responsibilities

Employers agree to:

  • Ensure all job postings are accurate, genuine, lawful and non-discriminatory.
  • Avoid misleading or deceptive conduct, in accordance with the as per each country governing law and Australian Consumer Law (ACL).
  • Handle candidates’ personal information in compliance with the Privacy Act 1988 (Cth).
  • Not misuse candidate data, sell data, or spam candidates.
  • Not misrepresent employment conditions (salary, visa requirements, duties, etc.).
  • Employers are always to check the information generated from AI platforms before publishing in the platform or for public and SKILLPOTS does not take any responsibility of the information provided by AI platforms.

SKILLPOTS does not act as an employer, contractor, representative or agent of any candidate.

Candidate Responsibilities

Candidates agree to:

  • Provide truthful and accurate profile and CV information.
  • Apply only for roles for which they meet eligibility.
  • Not misuse employer contact information.
  • Employees are always to check and verify the information generated from AI platforms before submitting to any employers or use for any other purpose as SKILLPOTS does not take any responsibility for information generated by AI platforms.

SKILLPOTS does not guarantee job offers, interviews, or employment outcomes.

Paid Services, Fees & Refunds

Some features require payment (e.g., premium job listings, boosted visibility, subscription packs).

  • Fees are displayed at time of purchase and are in AUD unless stated otherwise.
  • Stripe or other payment processors may be used; their terms also apply.
  • Refunds are provided only according to our published Refund Policy.
  • SKILLPOTS is not responsible for third-party processing errors or delays.

Prohibited Conduct

Users must not:

  • Engage in data scraping, harvesting, or automated collection.
  • Upload viruses or harm the Platform’s security.
  • Misrepresent identities or create multiple fraudulent accounts.
  • Use the Platform for illegal, harmful, or exploitative purposes.
  • Post misleading job ads, pyramid schemes, or solicitations unrelated to recruitment.

Breaches may result in account termination, removal of content, and reporting to authorities.

Intellectual Property

Everything on the Platform (software, branding, UI/UX, features, code, content) is owned or licensed by SKILLPOTS. You may not reuse, copy, sell, or commercially exploit it without permission.

Data Protection & Privacy (Australia-Based Storage)

SKILLPOTS handles personal data in accordance with:

  • Privacy Act 1988 (Cth)
  • Australian Privacy Principles (APPs)
  • Data storage and transfers may involve cloud servers located in Australia or trusted international partners.

Key privacy commitments:

  • We only collect what is necessary.
  • We notify users about use and disclosure.
  • We secure data using industry-standard protection.
  • Users may request access or correction to their personal information.
  • If a data breach occurs, we comply with the Notifiable Data Breach Scheme (NDB) of Australia.

A separate Privacy Policy will provide full details.

Third-Party Services

The Platform may integrate with third-party systems (verification tools, applicant tracking systems, analytics and AI tools). SKILLPOTS is not responsible for their performance or compliance.

Marketing, Communications & Data Use Consent

By creating an account, using the Platform, or providing your personal information to SKILLPOTS, you acknowledge and agree that SKILLPOTS may collect, use, store, and disclose your personal information for marketing, promotional, business development, and service improvement purposes, in accordance with applicable laws including the Privacy Act 1988 (Cth), the Australian Privacy Principles, and the Spam Act 2003 (Cth).

You expressly consent to SKILLPOTS using your personal information to:

  • Send marketing and promotional communications
  • Provide service updates, job alerts, and platform features
  • Conduct surveys, analytics, and research
  • Improve and promote the Platform

You may opt out at any time via unsubscribe links or by contacting support@skillpots.com.

Platform Role and No Agency Relationship

SKILLPOTS is a technology platform that facilitates connections between employers and candidates. SKILLPOTS is not:

  • an employer
  • a recruitment agent
  • a labour hire provider
  • an employment agency
  • or a representative of any user

SKILLPOTS does not participate in employment contracts or hiring decisions.
All employment relationships are solely between employers and candidates.

Verification Disclaimer

SKILLPOTS does not independently verify:

  • user identity
  • qualifications
  • employment history
  • licenses
  • references
  • business legitimacy

Users are solely responsible for conducting their own due diligence.
SKILLPOTS is not liable for fraudulent or misleading conduct by users.

11D

No Guarantee of Results

SKILLPOTS does not guarantee:

  • job placement
  • hiring success
  • candidate suitability
  • recruitment outcomes
  • response rates

The Platform is a facilitation service only.

11E

User Disputes Release

SKILLPOTS is not responsible for disputes between users.
To the maximum extent permitted by law, users release SKILLPOTS from claims arising from:

  • employment decisions
  • hiring outcomes
  • job offers
  • user communications
  • user conduct

Service Availability and Downtime

SKILLPOTS does not guarantee uninterrupted availability.
The Platform may be modified, suspended, or discontinued at any time without notice.
SKILLPOTS is not liable for service interruptions.

11G

Cybersecurity and Data Loss Disclaimer

SKILLPOTS uses reasonable safeguards but does not guarantee protection against:

  • cyberattacks
  • hacking
  • unauthorised access
  • data loss
  • system failures

Use of the Platform is at your own risk.

11H

Right to Remove Content and Restrict Access

SKILLPOTS may remove content or suspend accounts at its sole discretion without notice or liability.

11I

AI and Automated Systems Disclaimer

The Platform may use AI systems.
SKILLPOTS does not guarantee accuracy of AI-generated content.
Users must independently verify information.

Force Majeure

SKILLPOTS is not liable for delays or failure caused by events beyond reasonable control, including:

  • natural disasters
  • cyberattacks
  • power outages
  • internet failures
  • government actions

International Users

Users outside Australia are responsible for compliance with local laws.
These Terms are governed exclusively by Australian law.

Free Services Limitation

Where services are provided free of charge, SKILLPOTS has no liability to the extent permitted by law.

Disclaimer & No Warranty

To the extent permitted by Australian law:

  • The Platform is provided “as is” and “as available.”
  • SKILLPOTS does not guarantee system uptime, accuracy of job ads, or the suitability of candidates.
  • SKILLPOTS is not liable for employment disputes between candidates and employers.

However, nothing in these Terms excludes guarantees mandated under the Australian Consumer Law (ACL).

Limitation of Liability

Except to the extent required by law:

  • SKILLPOTS is not liable for indirect, incidental, consequential, or special damages.
  • SKILLPOTS’ total liability for any claim is limited to the amount paid for services in the last 12 months (or AUD $500 if unpaid).

ACL rights may apply and cannot be excluded.

Indemnity

You agree to indemnify SKILLPOTS from any claims, losses, liabilities, or expenses arising from:

  • your breach of these Terms
  • misuse of the Platform
  • infringement of third-party rights
  • misleading job ads or fraudulent applications

Suspension & Termination

SKILLPOTS may terminate or suspend access if Users:

  • breach Terms
  • engage in fraudulent or harmful activity
  • misuse platform features
  • violate employment or privacy laws

Upon termination, your licence to use the Platform ends immediately.

Governing Law

Because the company is incorporated in Australia:

  • These Terms are governed by the laws of Australia,
  • Specifically, the laws of the state/territory in which SKILLPOTS is registered in QLD
  • Disputes will be resolved in the Australian courts of that state/territory.

Changes to the Terms

We may update these Terms at any time. Material changes will be communicated through the Platform or via email. Continued use means acceptance of the updated Terms.
